These Terms and Conditions (“Terms”) govern your use of airlectronics.co.za (the “Site”) and any purchase you make from Airlectronics (Pty) Ltd (“Airlectronics”, “we”, “us”, “our”), registration number [insert CIPC registration number], of [insert registered business address]. By using the Site or placing an order, you agree to these Terms. Please read them together with our Privacy Policy and Delivery & Returns Policy.
1. About us
Airlectronics is a South African electronics retailer selling new, certified refurbished, pre-owned and open-box electronics. You can reach us at support@airlectronics.co.za.
2. These Terms and the law
These Terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (“CPA”) and the Electronic Communications and Transactions Act 25 of 2002 (“ECTA”). Nothing in these Terms limits any right you have under the CPA or ECTA that cannot lawfully be excluded or limited.
3. Placing an order
Product listings on the Site are an invitation for you to make an offer to purchase, not an offer by us to sell. When you place an order, you are making us an offer to buy the listed product(s) at the listed price. A contract is only formed once we accept your order and payment has been confirmed; we will send you an order confirmation by email at that point. We may decline or cancel an order (with a full refund) if, for example, a product is out of stock, priced incorrectly due to an error, or we suspect fraud.
4. Pricing and payment
All prices on the Site are displayed in South African Rand (ZAR) and, unless stated otherwise, include VAT at the applicable statutory rate. While we make every effort to display accurate pricing, errors can occur; if a pricing error is discovered on an unfulfilled order, we will contact you before processing it further, and you may choose to proceed at the correct price or cancel for a full refund.
Payments are processed securely by Yoco, an independent, PCI-DSS-compliant payment service provider. We do not have access to, and do not store, your full card details.
5. Product condition and descriptions
We describe every product’s condition (New, Certified Refurbished, Pre-owned, or Open Box) clearly on its product page, along with the warranty that condition carries. See our Warranty & Guarantee page for details. We take reasonable care to ensure product descriptions, images and specifications are accurate, but minor variations (such as packaging design) may occur.
6. Delivery
We aim to deliver orders within 3-5 working days of dispatch, using our courier partner, Bob Go, subject to the delivery area and full terms set out in our Delivery & Returns Policy. Risk in the goods passes to you on delivery; ownership passes once we have received payment in full.
7. Returns, refunds and warranty
Your rights to return a product, whether because you’ve changed your mind or because a product is faulty, are set out in full in our Delivery & Returns Policy and Warranty & Guarantee page, both of which form part of these Terms. Returns are requested through your My Account area and reviewed by our team before a refund is processed; refunds are only ever issued once a shipment is confirmed not to be in transit with our courier, to avoid duplicate deliveries.
8. Your account
You’re responsible for keeping your account login details confidential and for all activity under your account. Let us know immediately at support@airlectronics.co.za if you suspect unauthorised use of your account.
9. Acceptable use
You agree not to use the Site for any unlawful purpose, to attempt to gain unauthorised access to our systems, to interfere with the Site’s operation, or to submit false or fraudulent orders.
10. Intellectual property
All content on the Site, including text, graphics, logos and images, is owned by or licensed to Airlectronics and may not be reproduced without our written permission, except as reasonably necessary to use the Site for its intended purpose.
11. Limitation of liability
To the fullest extent permitted by law, Airlectronics will not be liable for indirect or consequential loss arising from your use of the Site or a product purchased from us. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under the CPA, including liability for harm caused by unsafe, defective or hazardous goods under section 61 of the CPA.
12. Electronic communications
By using the Site and providing your email address, you consent to receiving order-related and (where you’ve opted in) marketing communications electronically, in accordance with ECTA. You may withdraw marketing consent at any time.
13. Changes to these Terms
We may update these Terms from time to time; the version in force at the time you place an order is the one that applies to that order. Material changes will be reflected by an updated date at the top of this page.
14. Contact and complaints
If you have a question or complaint, please contact us first at support@airlectronics.co.za so we can try to resolve it directly. If we can’t resolve a consumer complaint between us, you may refer it to the National Consumer Commission or, where applicable, your industry ombud.
